1. Introduction

Our mission at The Fitting Room Canada, Inc. (“The Fitting Room”, “TFR”, “we”, “us”) is to redefine the way we shop for apparel online. We enable you to virtually try-on and order made-to-fit garments in the comfort of your own home. We believe that the privacy of a fitting room in the real world should also apply in the virtual one. 

We have prepared this Privacy Policy to help you understand how we collect, use, and share your personal information when using our website, our mobile app, or other services we provide (collectively our “Services”). This Privacy Policy is incorporated in and forms part of our Terms of Service.

2. Roles and responsibilities

Unless otherwise stated, TFR is the controller of your personal information as described in this Privacy Policy. Please note that this Privacy Policy does not apply to the personal information we process on behalf of our customers in the role of processor, sub-processor, or service provider such as when our customer provides you with access to our Services. In such cases, our customer is the controller of your personal information and we process that information solely at their direction as outlined in our agreement with them. All privacy related inquiries should therefore be directed to the customer. 

3. Data we collect and how we use it

When you use our Services we collect your personal information and generally use it to provide you with and improve those Services.

Information about you that you provide us such as your name, gender, birthdate, email address, phone number, and address.

  • To provide you with and improve our Services.

  • To communicate with you about our Services (e.g. order fulfilment, customer service).

  • On an opt-in basis, to communicate with you about our latest features, designs, and offers.

  • To generate aggregate statistical or de-identified insights to improve our Service.

Body measurements that you provide us such as your height, a selfie, and a video of you doing a 360 degree turn.

  • To create your 3D reconstruction and allow you to virtually try-on made-to-fit garments.

  • To generate aggregate statistical or de-identified insights to optimize our 3D reconstruction technology.

  • Please note that we delete your 360 turn video after we create your 3D reconstruction.

Payment  information you provide us such as your payment card information and billing address.

  • To process your payment requests.

Transaction information for orders you make using our Services. 

  • To process your orders and maintain our financial records.

  • To generate aggregate statistical or de-identified insights on the performance of the products offered through our Services.

Cookies and similar technologies such as pixels, and web beacons that are automatically generated when you use our Services. 

  • To support basic functionality and security of our Services such as authentication and session management.

  • To understand how you interact with our Services and to improve your user experience. 

  • To provide advertisements tailored to your interests.

Usage analytics that are automatically generated when using our Services such as your IP address, device type, browser, or operating system.

  • To support basic functionality of our Services such as localization and compatibility.

  • To understand how you interact with our Services and to improve your user experience.

Information from third parties such as your activity or account information made available to us when you interact with social media through our Services. Please note such information is governed by the privacy policy of the applicable third party.

  • To enable you to like, share, post, or otherwise interact with social media platforms like Instagram, Facebook, or Twitter through our Services.

  • To understand how you interact with our Services and to improve your user experience.

4. How we protect your data

Protecting the personal information you entrust us with is our priority. We implement a combination of administrative, physical, and technical measures to safeguard your personal information and only retain it for as long as necessary to provide you with our Services or to comply with applicable laws. We primarily store your information in Canada and the United States. As a global company, some of our operators and service providers may access, process, or store your personal information outside of these regions. 

5. How we share your data

We may share your personal information in the following ways:

  • With our service providers in connection with providing you our Services. These service providers include payment processors, garment manufacturers, shipping providers, technology providers, and advertising partners. We only share the data necessary to provide the service and work to ensure that our service providers protect your information in the same manner that we do.

  • With third parties in connection with providing you our Services. Examples include when we work jointly with another organization on a service or when you share something on your social media through our Services. You will be informed upon signing up for such programs or services and you can review the applicable privacy policies.

  • In aggregated statistical or de-identified form with third parties for the purposes of research, planning, or product development. In such cases, we employ robust de-identification methods to ensure your personal information is not disclosed.

  • If we sell or transfer all or part of our business for which your personal information is an asset in connection. If this happens, we will comply with the legal requirements associated with the disclosure of your personal information.

  • As required or permitted by Canadian law.

6. Your choices and rights

We seek to give you as much control over your personal information as is possible in the context of our Services. In our apps, we provide you with some choices as to what personal information you share with us (e.g. selfie or no selfie) as well as your communication preferences (e.g. opt-in to commercial electronic messages). Moreover, you can also set your browser or device settings to accept, refuse, or delete cookies. If you do choose to reject cookies, some of the functionality within our Services may not be available to you. You are responsible for ensuring the accuracy, correctness, and completeness of the information you provide us and your choices - so please keep us up to date! 

Under Canadian privacy law, you have the right to access the personal information we have about you. At your request and absent any legal restrictions we will provide you with this information in compliance with applicable laws. If we are unable to provide you with a response to your satisfaction you may bring the matter to the attention of the appropriate Privacy Commissioner.

We regularly update our privacy practices and may therefore update this policy from time to time - we encourage you to check back regularly. The last modified date at the top of this Policy indicates when it was last modified. For anything major - we will send you an email.
